Recreational Possession Limits
Minnesota uses a two-tier possession system — one set of limits for public carry and a more generous allowance at home. This structure recognizes that people may store more cannabis at their residence than they would carry in public.
| Product Type | In Public (21+) | At Home | Medical Patient |
|---|---|---|---|
| Cannabis flower | 2 ounces | 2 pounds | Up to 90-day supply |
| Concentrates | 8 grams | 8 grams | Up to 90-day supply |
| Edibles (THC content) | 800 mg THC | 800 mg THC | Up to 90-day supply |
Public Possession (Outside Your Home)
When you are outside your residence — walking, driving, at a friend's home, or anywhere else in public — you may possess:
- 2 ounces (56g) of cannabis flower
- 8 grams of concentrate (wax, shatter, oil, cartridges)
- 800 milligrams of THC in edible products
These limits apply to the total combined amount you are carrying, not per product type. If you have 1.5 oz of flower and 4g of concentrate, you are within both limits individually.
Home Possession
At your primary residence, you may possess significantly more:
- 2 pounds (907g) of cannabis flower
- 8 grams of concentrate
- 800 milligrams of THC in edible products
The 2 lb home limit is one of the most generous in the country and is designed to accommodate home cultivators who may harvest multiple plants at once.
The 2 lb home possession limit applies to your primary residence only. If you are visiting someone else's home or staying at a hotel, the public possession limit of 2 oz applies to what you personally possess at that location.
Purchase Limits
Purchase limits at licensed dispensaries mirror the public possession limits:
- 2 oz flower per transaction
- 8g concentrate per transaction
- 800mg THC in edibles per transaction
There is no daily purchase cap or tracking system that prevents you from visiting multiple dispensaries in a single day, but you may not exceed public possession limits at any time while outside your home.
Medical Patient Limits
Registered medical patients have different and generally more generous possession limits:
- Possession amounts are pharmacist-determined based on individual medical needs
- Patients may receive up to a 90-day supply per dispensary visit
- Maximum 90-day supply: 450 grams of flower (approximately 1 lb)
- Medical possession limits take precedence over recreational limits
Medical patients should always carry their registration card to demonstrate compliance with medical limits. For more on the medical program, see Medical Program.
Gifting Limits
Adults 21+ may gift cannabis to another adult 21+ without any exchange of money, goods, or services:
- Up to 2 oz flower
- Up to 8g concentrate
- Up to 800mg THC in edibles
The recipient's total possession after receiving the gift must not exceed the applicable possession limits.
Vehicle Storage
When transporting cannabis in a vehicle:
- Cannabis must be in its original sealed packaging from the dispensary
- If the package has been opened, it must be stored in the trunk or a locked compartment not accessible to the driver or passengers
- An open package accessible to any occupant constitutes a misdemeanor
- The total amount in the vehicle must not exceed public possession limits (2 oz flower, 8g concentrate, 800mg edibles)
Penalties for Exceeding Limits
Possession over the legal limits carries escalating penalties:
| Amount Over Limit | Classification | Maximum Penalty |
|---|---|---|
| 2–4 oz in public | Petty misdemeanor | $300 fine, no jail |
| 4 oz – 2 lbs in public | Misdemeanor | 90 days jail, $1,000 fine |
| Over 2 lbs (any location) | Felony | 5 years prison, $10,000 fine |
For the complete penalty chart including sale, distribution, and cultivation violations, see Penalties.
The jump from petty misdemeanor ($300 fine) to felony (5 years, $10K) happens quickly. Keep track of how much you possess, especially when combining flower, concentrates, and edibles. When in doubt, err on the side of carrying less.
