Social Equity in Minnesota Cannabis

Minnesota's cannabis law includes some of the strongest social equity provisions in the country — from license reservations and grant programs to automatic expungement and a dedicated Division of Social Equity.

Minnesota Statutes §342.17 establishes one of the most comprehensive social equity frameworks in any state cannabis program. The law goes beyond simply prioritizing applications — it creates dedicated grant programs, requires majority ownership by verified social equity individuals, established a Division of Social Equity within the Office of Cannabis Management (OCM), and has already delivered on its promises: 55% of all licenses have gone to social equity applicants, with four license categories at 100% social equity.

Who Qualifies as Social Equity?

Under §342.17, an individual qualifies for social equity status if they meet any one of the following criteria:

  • Cannabis conviction (self or family member) — The applicant, or a family member, was convicted of a cannabis offense before May 1, 2023 (the date of legalization)
  • Veteran — The applicant is a military veteran
  • Emerging farmer — The applicant qualifies as an emerging farmer under Minnesota law
  • Long-term resident of a disproportionately impacted area — The applicant has been a resident for 5 or more years of a census tract that meets any of the following criteria:
    • Disproportionate cannabis enforcement rates
    • Poverty rate of 20% or higher
    • Median household income below 80% of the statewide median
    • 20% or higher SNAP participation rate
    • High social vulnerability index score

65% Ownership Requirement

Social equity businesses must maintain 65% controlling ownership by verified social equity individuals for a minimum of 3 years. This provision is designed to prevent "equity washing" — situations where social equity status is used to obtain a license but actual control quickly passes to non-qualifying investors or operators.

  • Ownership must be controlling — not just a financial stake, but actual decision-making authority
  • The OCM verifies ownership structures during application review and through ongoing compliance monitoring
  • Violations of the ownership requirement can result in license revocation

License Reservations

50% of all capped licenses are reserved for social equity applicants. The capped categories and their SE reservations:

  • Mezzobusiness: 50 of 100 licenses reserved for SE
  • Cultivator: 25 of 50 licenses reserved for SE
  • Manufacturer: 12 of 24 licenses reserved for SE
  • Retailer: 75 of 150 licenses reserved for SE

As of early 2026, the results have exceeded the 50% target: 55% of all licenses have been awarded to social equity applicants, with four individual license categories at 100% social equity.

Social Equity Lottery

The OCM uses a dual lottery system to award capped licenses. The social equity lottery runs first, followed by the general lottery:

  • June 5, 2025: Social equity lottery — 249 licenses awarded to verified SE applicants
  • July 22, 2025: General lottery — remaining licenses awarded to all eligible applicants

This structure ensures that social equity applicants receive first access to the limited pool of capped licenses before the general applicant pool.

Grant and Support Programs

Minnesota has created five named programs to support social equity cannabis entrepreneurs. Funding levels have increased significantly as the market has developed:

CanRenew

The flagship grant program for social equity cannabis businesses. Provides direct financial assistance for startup costs, facility buildout, equipment, and working capital.

  • FY2025: $1 million allocated
  • FY2027: Scaled to $10 million — a 10x increase reflecting the state's commitment to SE support

CanGrow

Focused on business development and capacity building for social equity applicants and licensees.

  • FY2025: $2 million allocated
  • Supports business planning, technical assistance, and operational development

CanStartUp

Administered through the Minnesota Department of Employment and Economic Development (DEED), CanStartUp provides startup loans to social equity cannabis entrepreneurs who may not qualify for traditional financing.

CanNavigate

Provides application assistance and regulatory navigation support. Helps social equity applicants understand the licensing process, prepare applications, and comply with OCM requirements.

CanTrain

Offers workforce training programs designed to prepare individuals from impacted communities for careers in the cannabis industry — not just as business owners but as employees across all license types.

Cannabis Expungement

Minnesota's legalization law included provisions for the automatic expungement of certain cannabis convictions. The Cannabis Expungement Board oversees this process, which has resulted in over 57,000 expungements — removing barriers to employment, housing, and civic participation for tens of thousands of Minnesotans.

Expungement is a critical component of the social equity framework because cannabis convictions have historically created barriers not only to entering the cannabis industry but to economic participation broadly. By clearing these records, Minnesota ensures that people impacted by the War on Drugs can fully benefit from legalization.

Division of Social Equity

The OCM includes a dedicated Division of Social Equity, led by Director Jess Jackson. The division is responsible for:

  • Verifying social equity applicant qualifications under §342.17
  • Administering grant programs (CanRenew, CanGrow, CanStartUp, CanNavigate, CanTrain)
  • Monitoring the 65% ownership requirement across SE licensees
  • Tracking and reporting on social equity outcomes in the licensing process
  • Providing an Ombudsperson function to assist social equity applicants and licensees with regulatory questions and dispute resolution

The Ombudsperson role is particularly important — it provides a dedicated point of contact within the OCM for social equity entrepreneurs who need help navigating the regulatory process, resolving compliance issues, or understanding their rights and obligations.

Results So Far

Minnesota's social equity program has delivered measurable results in its first year of operation:

  • 55% of all licenses awarded to social equity applicants (exceeding the 50% target)
  • 4 license categories at 100% social equity
  • 249 licenses awarded through the SE lottery on June 5, 2025
  • 57,000+ expungements processed through the Cannabis Expungement Board
  • $13+ million in grant funding allocated across CanRenew and CanGrow programs

These outcomes make Minnesota one of the most successful state cannabis social equity programs in the country — though advocates continue to push for stronger capital access programs and faster grant disbursement to help SE licensees convert their approvals into operational businesses.

The Office of Cannabis Management shall establish a social equity program to promote participation in the cannabis industry by individuals from communities that have been disproportionately impacted by cannabis prohibition.
